TERMS OF USE

These Terms of Use govern your access to and use of rewind981.com, the Rewind 98.1 FM mobile app, and any related pages, feeds, or services we operate (together, the "Site"). The Site is owned and operated by Hill Broadcasting, which operates Rewind 98.1 FM and 93.5 FM ("Rewind," "we," "us," or "our").

By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Who May Use the Site

You may use the Site if you are able to form a binding contract with us and are not barred from doing so under applicable law. If you use the Site on behalf of a business, you represent that you are authorized to bind that business to these Terms.

The Site is intended for a general audience and is not directed to children under 13. Entry into our giveaways requires you to be at least 18.

2. Our Content

All content on the Site, including text, graphics, logos, station marks, photographs, audio, video, layout, and the selection and arrangement of that content, is owned by us or by our licensors and is protected by copyright, trademark, and other laws.

The Rewind 98.1, Rewind 93.5, and Hill Broadcasting names and logos are our trademarks. You may not use them without our prior written permission.

You may view, download, and print content from the Site for your own personal, non-commercial use. You may not copy, reproduce, republish, distribute, sell, license, modify, create derivative works from, frame, scrape, data-mine, or use any automated system to harvest content from the Site without our prior written permission.

Third-party content on the Site, including music, advertising, event listings, syndicated news, and embedded media, remains the property of its respective owner.

3. Audio Streaming

Our live stream and any on-demand audio are provided for your personal, non-commercial listening only. You may not rebroadcast, retransmit, record for redistribution, publicly perform, or embed our stream on another website or service without our prior written permission. The stream is delivered through third-party providers and may be interrupted, changed, geo-restricted, or discontinued at any time without notice.

4. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable law or regulation
• Submit false, misleading, or fraudulent information
• Upload or transmit any virus, malware, or other harmful code
• Attempt to gain unauthorized access to the Site, our servers, our accounts, or any connected system
• Interfere with, disrupt, overload, or attempt to probe or test the vulnerability of the Site or its security measures
• Use bots, scrapers, crawlers, or automated tools to access the Site, except for search engine crawlers acting in accordance with our robots file
• Harass, threaten, defame, or impersonate any person, including our staff and on-air talent
• Post or submit content that is unlawful, obscene, hateful, infringing, or invasive of another person's privacy
• Use the Site or our content to compete with us or to build a commercial product or service

We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have violated these Terms.

5. Content You Submit

When you submit anything to us through the Site, by email, by text, through our forms, or on our social media pages, including song requests, event listings, photographs, videos, comments, reviews, and testimonials ("Your Content"), you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, adapt, edit, broadcast, publish, display, and distribute Your Content in any medium, in connection with the operation and promotion of the Station.

You represent that you own or control all rights to Your Content, that it does not infringe anyone's rights, and that any person shown or heard in it has consented to its use.

We are not obligated to use, publish, broadcast, or retain Your Content, and we may edit or remove it at any time for any reason. Do not send us anything you consider confidential or do not want made public.

6. Giveaways and Promotions

All contests, giveaways, sweepstakes, and promotions are governed by our Contest Rules and by the Specific Rules for that promotion. Our online giveaways are administered through SweepWidget, a third-party platform with its own terms and privacy policy. By entering, you agree to both our rules and SweepWidget's terms.

7. Advertising and Third-Party Links

The Site contains advertising, sponsored content, prize sponsor promotions, and links to third-party websites and services. We provide these for convenience. We do not control third-party sites and do not endorse, guarantee, or take responsibility for their content, products, services, availability, or privacy practices. Your dealings with any advertiser or third party found through the Site are solely between you and that party.

8. News, Weather, and Event Information

News, weather, traffic, event listings, and community information on the Site are provided for general information only. We work to keep this information accurate and current, but we do not guarantee it. Do not rely on the Site for emergency information. In an emergency, follow instructions from local authorities and official emergency channels.

9. Copyright Complaints

If you believe content on the Site infringes your copyright, send a written notice to our designated agent that includes: your physical or electronic signature, identification of the copyrighted work claimed to be infringed, identification of the material you claim is infringing and its location on the Site, your contact information, a statement that you have a good faith belief the use is not authorized by the copyright owner or the law, and a statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

We will respond to valid notices as required by the Digital Millennium Copyright Act and may remove the material and terminate repeat infringers.

10. FCC Public Inspection File

11. Disclaimer of Warranties

The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Site will be uninterrupted, timely, secure, or error free, that defects will be corrected, or that the Site or its servers are free of viruses or other harmful components.

12. Limitation of Liability

To the fullest extent permitted by law, neither Hill Broadcasting nor its owners, officers, employees, agents, or content providers will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business opportunity, arising out of or related to your use of or inability to use the Site, whether based on warranty, contract, tort, statute, or any other legal theory, even if we have been advised of the possibility of such damages.

Our total liability to you for all claims arising out of or relating to the Site or these Terms will not exceed one hundred dollars ($100.00).

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Hill Broadcasting and its owners, officers, employees, and agents from any claim, demand, loss, liability, damage, cost, or expense, including reasonable attorneys' fees, arising out of your use of the Site, Your Content, your violation of these Terms, or your violation of any law or the rights of a third party.

14. Changes to the Site and to These Terms

We may change, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms. When we do, we will revise the effective date at the top of this page. Your continued use of the Site after an update means you accept the revised Terms.

15. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Kern County, California, and you consent to the jurisdiction of those courts.

16. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of that provision. These Terms, together with our Privacy Policy and Contest Rules, are the entire agreement between you and us regarding the Site. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
